USRAP Questions South Africa: A Legal FAQ for Families

Health, old criminal records, missing documents, absent parents and the cost of starting again in America are not minor details in a refugee application. They can affect different parts of the process, and an answer that was correct for another family may be wrong for yours.

This guide addresses questions raised by South African families considering or moving through the U.S. Refugee Admissions Program. The questions have been rewritten and anonymised. Community experiences can be useful, but they are not decisions on eligibility, medical clearance, parental rights or benefits.

Legal and source review: 19 October 2026. Programme access, case instructions and benefits can change. This is general information, not a determination of an individual case. LexMigrate is independent of USCIS, the U.S. Embassy, RSC Africa and resettlement providers. Clinical decisions belong with the treating clinician and designated medical team; U.S. representation requires an appropriately authorised professional.

USRAP application eligibility for South African families

1. Must we be farmers to qualify for USRAP?

Farming is not part of the statutory definition of a refugee. A person’s occupation does not, on its own, establish or defeat a refugee claim. Access to a particular processing initiative must also be distinguished from proving refugee eligibility and admissibility. 1, 2

A family should therefore check the current access criteria and assess its own circumstances. Being white, being Afrikaans-speaking, owning land or wanting a safer future is not a substitute for establishing the requirements that apply to the application. Equally, not being a farmer should not be treated as a conclusive legal answer.

2. Can a house robbery, racial employment discrimination or a threat involving a firearm establish a claim?

These events can be relevant, but no responsible assessment can promise eligibility from a short description. The legal enquiry includes what happened, its seriousness, the reason for the harm or feared harm, the relevant protected ground and the availability of protection. Several events may need to be considered together. 1

Describe the actual incident, what was said, why you believe you were targeted, any response by the authorities and the supporting evidence. General crime, economic difficulty and persecution are not interchangeable concepts. An applicant should neither minimise genuine harm nor reshape ordinary events to fit someone else’s successful account.

3. Does membership of Solidariteit automatically make an applicant ineligible?

No published official rule establishing an automatic exclusion solely for Solidariteit membership has been verified for this article. That is not a promise about the outcome of an individual case, nor evidence that membership is irrelevant to every question an officer may ask.

Answer questions about organisational memberships and activities truthfully. A community report that a member was approved or refused does not establish why that decision was made. Anyone claiming a blanket membership ban should identify the actual official rule, rather than infer one from isolated outcomes.

USRAP mental health questions: depression, anxiety and medication

4. Does depression or anxiety automatically prevent acceptance?

No. A diagnosis alone is not an automatic medical refusal. CDC instructions distinguish a mental disorder without associated harmful behaviour from a disorder associated with harmful behaviour; substance-use classifications involve additional rules. A clinical history cannot be reduced to the label depression or anxiety. 3

Disclose the history accurately when asked, including treatment, relevant admissions and medication. The designated physician may request a treating practitioner’s report or specialist evaluation. Do not stop treatment, conceal symptoms or alter medication to try to influence the examination. An individual medical classification and immigration decision still need to be made.

5. How should someone with an existing condition prepare for treatment after arrival?

Prepare a continuity-of-care plan with the treating clinician. A useful handover identifies the diagnosis, generic medication names, doses, allergies, relevant treatment history and the follow-up needed. Ask the receiving provider how appointments, prescriptions and urgent care will be arranged. 4

Do not assume a South African brand, prescription or specialist arrangement transfers automatically. Availability and coverage depend on the medication, provider, location and benefit or insurance arrangements. Other refugees’ experiences may help identify practical questions, but cannot establish what treatment will be available to a particular patient.

6. Can chronic medication keep being sent from South Africa?

Do not build a treatment plan around the assumption that medicines can routinely be posted from South Africa. FDA rules restrict personal importation, including many foreign prescription medicines, and limited enforcement discretion does not create a general right to import. Controlled medicines raise additional requirements. 5

Discuss a lawful initial supply and the transition to U.S. prescribing with the medical team before departure. Keep medicines correctly labelled and retain prescriptions and a clinician’s letter. Confirm the rules applicable to the particular medicine and travel or shipment; another person’s successful parcel is not evidence that future imports are lawful or dependable.

USRAP criminal records, expungement and previous service

7. Will a minor criminal matter from 26 years ago automatically cause refusal?

Not necessarily. The description minor is not a legal classification under U.S. immigration law. The actual offence, disposition, sentence and relevant immigration grounds must be examined. The age of the case may matter, but does not make the history disappear. Arrest, conviction and immigration inadmissibility are different questions. 6

Obtain the available court outcome and explain what occurred accurately. Some criminal grounds have exceptions or potentially available waivers, while others are substantially more restrictive. No one should promise acceptance or inevitable refusal without reviewing the record and the applicable law.

8. Should I wait for expungement before attending requested fingerprints or an MIE appointment?

Expungement should not be treated as a way to avoid disclosure required by a U.S. application or interview. A clear police result and the obligation to answer questions about past arrests, charges or convictions are separate issues. U.S. law has its own definition of conviction and rules about criminal history. 1, 6

Follow the actual instructions issued for your case and the specific fingerprint or screening appointment. If expungement is pending, explain that and retain proof. Ask the processing team before changing an appointment; do not assume that waiting will improve eligibility or that a private screening result replaces the complete legal history.

9. Will postponing fingerprints close our case?

There is no reliable general answer without the appointment notice and the case instructions. An authorised rescheduling request is different from failing to attend or ignoring a deadline. Silence should not be treated as permission to postpone.

Ask promptly through the designated case channel, give the reason and request written confirmation of any new arrangement. Keep the original instruction and the response. This article cannot promise that a case will remain open, or say that every postponement causes closure.

10. Must I disclose a foreign arrest if the accusation was false and the case was dismissed?

If the question asks whether you have ever been arrested, charged or detained, a dismissal does not change the fact that the event occurred. Answer the question asked and explain the dismissal. Do not describe an acquittal or dismissal as a conviction, but do not conceal the arrest because you believe the accusation was unjustified. 1, 6

Seek the arrest or charge record and the final court order or other official disposition. If records cannot be obtained, preserve evidence of the requests and explain the limitation. A sworn account may assist an explanation, but should not be represented as a guaranteed substitute for official records.

11. Does earlier South African military service automatically prevent refugee admission?

Military service alone does not decide every case. The enquiry may include the unit, rank, duties, deployments, command responsibilities and actual conduct. Compulsory service should be explained as such, but it does not remove the need to answer questions about what occurred. 1, 6

The refugee definition excludes a person who ordered, incited, assisted or otherwise participated in persecution on a protected ground. Security and other inadmissibility provisions may also require examination. A service history involving potentially serious conduct needs individual legal review; a generic assurance that everyone who served is either excluded or protected is unsafe.

12. What should former SAPS officers or military members do about service records?

Prepare an accurate chronology of service, including former force or unit names, dates, roles, ranks, stations and deployments. Distinguish administrative duties from operational duties and explain uncertainty rather than inventing precise dates. Retain service, discharge and disciplinary records that are available. 7

The State Department’s South Africa civil-document guidance includes information about military records, but applicants should confirm the current custodian and the actual records requested for their case. A clean criminal certificate does not, by itself, answer every question about conduct during police or military service.

USRAP intake questionnaire and MyCase document uploads

13. Must every MyCase document be uploaded before the pre-screen interview?

Follow the upload instructions and deadline in the actual invitation. There is no verified universal rule in this article allowing every document to be supplied later. If passports or civil records are still outstanding, tell the processing team what is missing, when it was requested and what proof is available.

Ask whether available records should be uploaded now and how pending documents should be recorded. Keep a document log. Do not cancel an interview, disregard a deadline or assume an extension merely because another family was allowed to complete its file afterwards.

14. The intake questionnaire requires a marriage certificate. Can I upload proof that I applied for it?

Do not assume a receipt is accepted as the certificate itself. If the portal will not proceed, obtain guidance from the designated processing channel about the missing record and whether an explanatory upload is permitted. A technical ability to upload a file does not establish that it satisfies the requirement.

If an explanation is authorised, identify it honestly as proof that the certificate is pending. Do not upload an unrelated document under a misleading description. Keep the request receipt and supply the proper record through the instructed process when available.

15. Where do I obtain a divorce decree if I cannot remember when I divorced?

Start with the court that granted the divorce, or the attorney who handled it. South African divorces are granted by courts; the relevant record may be held by a High Court registrar or the appropriate Regional Court division. Older records may have moved to archives. 7, 8

Provide both parties’ full names, former surnames, identity numbers, the approximate period and likely court. Search old correspondence or payment records for the case number. Ask the court what tracing information and identification it needs. Request the appropriate court-issued record, rather than assume a change in Home Affairs marital status replaces the decree.

16. Will a laminated or plastic-covered birth certificate be rejected?

Acceptance depends on the receiving authority’s authenticity and document requirements. Lamination can interfere with examination, but this article cannot confirm that every laminated document is rejected or that a particular covered certificate will be accepted.

Preserve the existing record and request a replacement if needed. Do not peel off the covering, chemically treat the certificate or digitally reconstruct an apparently clean original. Explain the condition honestly and ask the processing team how it wants the document supplied. The aim is an authentic, verifiable record, not a cosmetically improved image.

17. Can I use the existing certificate and upload a replacement with a different certificate number later?

Ask for case-specific instructions before relying on a later replacement. A newly issued certificate can have different issue details, but it should still accurately identify the person and underlying civil event. A changed serial or issue number is not, by itself, proof of a different identity or of fraud.

Keep copies of both versions and an explanation of why the replacement was obtained. If names, parentage, dates or other substantive details differ, those differences require clarification. Do not quietly substitute a new document and leave an apparent inconsistency unexplained.

Children, guardianship and U.S. ties

18. My children have not seen their father for six years. Can they leave South Africa without his consent?

An absent parent does not automatically lose parental responsibilities, rights or guardianship. Under sections 18(3)(c) and 18(5) of the Children’s Act, relevant consent requirements and any court order must be considered. A person’s legal position cannot be inferred only from the length of time without contact. 9

Review existing orders, the parents’ legal status and who holds guardianship. If a required guardian cannot be located or will not consent, appropriate court relief may be needed. Permission to enter the United States does not itself authorise removal of a child from South Africa.

19. Do I need sole custody before making a USRAP enquiry?

Not every family needs the same order, and sole custody is not a reliable shorthand for every issue. Care, contact, guardianship, passport consent and relocation authority are distinct questions. Existing orders may already address some of them; others may need further relief. 9

Do not give up on an enquiry solely because the other parent is absent, but do not promise the child’s lawful relocation before the position is reviewed. Obtain family-law advice early enough to identify tracing, notice and court requirements without making an unnecessary or incorrectly framed application.

20. Can I add a U.S. tie after approval?

Ask the designated processing team as soon as the information changes. Whether a tie can still be considered may depend on allocation, assurances, placement and travel arrangements. This article has not verified a universal final stage or an automatic right to change placement after approval.

Provide accurate contact information with the person’s consent and explain the relationship. Ask whether the update affects an existing arrangement and whether any further step is required. Do not assume that editing information, or sending it to an unofficial helper, guarantees a new placement.

21. Does a U.S. tie guarantee housing, employment or placement near that person?

No such guarantee should be inferred from the word tie. Confirm the role the contact is actually willing and able to play, and distinguish a family connection from a formal sponsorship or provider arrangement. A friend’s offer to help does not establish the terms of programme assistance.

Discuss location, temporary accommodation, transport, medical access and realistic financial help before relying on the contact. Confirm the actual placement with the responsible organisation. Do not sign a lease or relocate independently on the assumption that the programme will reimburse it.

Fingerprints, medical appointments and vaccinations

22. Why did my husband receive fingerprint instructions when I did not?

Different messages do not, by themselves, establish that a spouse has been excluded or refused. Processing instructions can be individual. Check each person’s contact details, spam folders, portal access and the wording identifying who must attend.

Ask the designated team whether a separate instruction remains outstanding. Do not attend on the assumption that one person’s appointment covers the whole household, and do not conclude that a missing message has a particular legal meaning without confirmation.

23. My medical status says in progress. How long before the booking email arrives?

An in-progress status is not a confirmed appointment. No reliable universal interval has been verified for the email. Check the portal and the contact channels used for the case, then follow the enquiry procedure in the instructions if a message appears missing.

Do not make an unauthorised private booking or incur non-refundable travel costs based only on another person’s timeline. If a deadline or apparent missed appointment is involved, identify the exact date and communication when asking for clarification.

24. Do the immigration medicals include a dental check?

The overseas examination includes a medical history and physical examination under the relevant technical instructions. It is not a promise of comprehensive dental treatment, nor should ordinary dental problems automatically be described as a refugee exclusion. The clinician decides whether a particular finding needs evaluation. 10

Disclose active infection, pain or relevant treatment and seek dental care for clinical reasons. Do not assume every filling must be completed before the examination or delay necessary care while waiting for it. Ask the designated medical provider what records it needs.

25. My child is behind on one vaccination. Should we catch up before the medical?

Take the child’s genuine vaccination records to a treating clinician and the designated medical team. They can identify the missing dose, timing, age appropriateness and any contraindication. Do not repeat a vaccine unnecessarily or change the schedule on the strength of a social-media answer. 11

A missing dose should be discussed accurately rather than concealed. Ask how treatment received before the examination should be documented so it can be reviewed. This article does not prescribe an individual child’s vaccination schedule.

26. Will refusing or missing any vaccination automatically result in a USRAP refusal?

That blanket statement is inaccurate. CDC distinguishes refugees from ordinary immigrant-visa applicants: routine vaccination is strongly recommended and offered overseas, but refugees are not generally legally required to receive routine vaccines before travel. Specific requirements can apply during outbreaks or other elevated-risk situations. 11

Later adjustment of status and school requirements are separate matters. Do not use this distinction as an instruction to disregard a medical team’s directions. Ask what applies to the specific vaccine, the reason for it, any clinical contraindication and the stage of the process.

27. Does processing stop over December and January?

No programme-wide December-to-January shutdown period has been verified for this article. Public holidays, individual office schedules and appointment availability are different from an official suspension of the entire process.

Follow the notices for the organisation handling the particular appointment. Do not assume a deadline is extended because it falls near the holidays. If an office is closed or an appointment cannot be attended, request instructions and retain the response.

Costs, employment and assistance after arrival

28. Can a South African family afford to survive in the United States?

There is no responsible national yes-or-no answer. Build a destination-specific budget covering housing deposits, utilities, transport, food, healthcare costs, childcare, communication and the period before reliable earnings. Use current local prices and realistic take-home pay, rather than compare rand and dollar salaries alone.

Ask what the receiving provider will supply, for how long, whether any money is a loan and what the family must fund itself. Temporary assistance is not a guarantee of a particular lifestyle. Keep a contingency for delays, health needs and transport to work.

29. If my partner starts working but I do not, does all support end?

Not necessarily, but it is equally unsafe to assume support continues until both adults are employed. Cash benefits, reception services, medical coverage and employment programmes have different rules. Household income may affect means-tested assistance even if the principal applicant has not found work. 12

Report earnings and household changes as required. Ask for the name of each programme, the applicable income rules, the benefit period and any written reduction or termination decision. The principal applicant label does not create a general exemption from household-income assessment.

30. Does starting work automatically end refugee medical assistance?

Refugee Medical Assistance has specific continued-coverage protections. Under 45 CFR 400.104, employment earnings do not affect the continued RMA eligibility of an existing recipient during the applicable time-eligibility period; the provision also addresses certain transitions from Medicaid and employer insurance. That is not a promise about every health programme or every family member. 13

Benefit periods also change. An ORR correction published on 1 October 2026 specifies a 12-month RCA/RMA eligibility period, with implementation within 30 days. Families should obtain current written confirmation of the programme and period applicable to them; this is not guaranteed cash or free comprehensive healthcare for every arrival. 14

Decisions before departure

31. When should I cancel South African medical aid?

Do not cancel solely because a portal stage changes or an approval message arrives. Consider the actual travel arrangements, cancellation notice terms, treatment needs and when replacement coverage and care will begin. Ask about any gap if departure is delayed or a prescription cannot immediately be filled.

Where finances permit, retaining cover until the transition is genuinely arranged reduces one avoidable risk. The appropriate date is a household decision informed by the policy and clinical circumstances, not a universal number of days before a flight.

32. When should I tell my university that I am leaving?

You can ask about withdrawal, deferment, remote study and financial consequences before making the decision final. Obtain written information about deadlines, fee liability, academic records and whether the place can be preserved if travel changes.

An immigration milestone should not be assumed to cancel a study contract or protect credits automatically. Separate gathering information from giving an irreversible withdrawal instruction. Make the final decision against confirmed case and travel information and your academic options.

33. When should I resign and arrange my provident-fund payment?

Check employment notice requirements and the fund’s actual payout, tax and documentation process early, without assuming the money will arrive before travel. Immigration processing does not set the employer’s or fund administrator’s timetable.

Avoid relying on a projected departure date to finance the move. Obtain written estimates and consider lawful alternatives if payment is delayed. The timing of resignation needs an individual financial and employment plan; no adviser can promise that an approval or booking eliminates every risk of changed travel arrangements.

34. When should we sell furniture, vehicles or our home?

Use a staged plan that preserves options as long as reasonably possible. Preparing an inventory or obtaining valuations is different from selling essential assets, terminating accommodation or committing the proceeds. Assess the consequences if travel is delayed or the case does not proceed.

Approval abroad and admission to the United States are distinct; 8 CFR 207.4 describes the role of the port-of-entry process. Even confirmed travel is not a guarantee that every contingency disappears. Do not treat social-media estimates as instructions to liquidate the family’s life in South Africa. 15

USRAP denial and ICP questions: appeals, letters and interview records

35. Does a letter to the President reopen every ICP case?

No. Political advocacy or a request for policy change does not, by itself, reopen an individual case. A submission should be distinguished from an actual instruction or decision by the authority responsible for processing. Do not treat circulating a letter as proof that cases are active again.

The regulation at 8 CFR 207.4 provides that there is no appeal from denial of refugee status. The particular notice, including any restriction on further processing or reapplication, must be read carefully. An oversight complaint, records request and any legally available review are different processes, not interchangeable appeal rights. 15

36. Would Priority 2 processing remove individual interviews or guarantee acceptance?

Do not assume that priority access determines the merits of every application. Identifying a group for processing is different from finding each applicant eligible and admissible. The statute retains an individual refugee-admission enquiry. 2

The current text of 8 CFR 207.2 requires applicants aged 14 or older to appear before an immigration officer for an inquiry under oath. A proposal to remove interviews does not amend that rule. Any claimed change must be checked against an actual lawful and operative policy or legal provision. 16

37. Does an ineligibility notice prove that someone is a criminal, liar or fraudster?

No. A negative processing outcome is not a public criminal conviction or proof of deliberate dishonesty. Eligibility, admissibility, credibility and administrative processing are different matters. Unless the actual reasons and evidence are known, outsiders should not invent an explanation.

Applicants should also avoid the opposite assumption that a refusal proves officer misconduct. Read the decision and obtain appropriate advice about what it actually establishes. Neither condemnation of applicants nor blanket accusations against officers replace evidence.

38. What if the interview record contains mistakes or the applicant was not allowed to explain?

Identify the specific passage, the alleged error and the evidence supporting the correction. Separate an inaccurate date, a translation problem, an incomplete summary and an allegation of intentional falsification. Those are different claims and should not be combined without a factual basis.

A lawfully obtained records disclosure may assist, subject to exemptions and redactions. Preserve the actual record and a careful chronology. Obtain advice about any available correction, oversight or case-specific legal process. A records request does not automatically pause a decision, create an appeal or prove fraud, and a summary not written in the applicant’s preferred words is not by itself proof of fabrication.

39. Does owning property or living in a gated community decide whether someone qualifies?

Neither wealth nor a particular address, by itself, resolves the statutory refugee enquiry. Relevant facts may include the actual threats, protection available and the person’s circumstances. Someone else’s view that a family ought to feel safe is not a legal decision. 1

Equally, a desire to preserve a lifestyle or escape financial pressure should not be presented as persecution without the necessary facts. A careful application explains the individual position honestly, without suggesting that assets guarantee exclusion or that poverty guarantees admission.

40. What should families verify before acting on group advice or a circulating advocacy letter?

Distinguish an official rule, a case instruction, a personal experience and a proposal for change. Check dates and the type of application involved. A person’s arrival in America does not make them qualified to decide another family’s legal, medical or guardianship position.

Specific reports of harm or misconduct deserve responsible attention, but unverified incidents do not establish a programme-wide rate or a finding of wrongdoing. Do not repeat private health histories, case numbers or accusations as established fact. The strongest preparation is accurate information, authentic records and a plan that remains workable if processing changes.

41. What if we cannot afford identity documents or travel to appointments?

Raise the practical difficulty with the designated processing team before missing an appointment or abandoning the enquiry. Ask what documents are required at the present stage, whether any authorised arrangement exists and which costs the household must fund. Do not assume an informal helper can waive an official requirement.

Keep written instructions and receipts. Paying a person for guaranteed access, faster approval or an undisclosed influence over a case is different from a transparent fee for independently chosen professional work. No private adviser can sell refugee status. A financial obstacle deserves a concrete planning discussion, not an invented document or a promise that the requirement will disappear.
