UK Spouse Visa South Africa

LexMigrate assists South African applicants and UK-based sponsors with spouse, civil partner, unmarried partner, fiancee and proposed civil partner visa applications.

A UK partner visa is not just a form-filling exercise. The Home Office looks at the relationship, financial position, accommodation, English language evidence, TB requirement where applicable, immigration history and the long-term intention to live together in the UK.

We help clients prepare the application properly from the start, especially where the facts are not simple.

Start with the figures

Free UK spouse-visa financial check

Check the financial amount for straightforward sponsor-salary or cash-savings cases. More complex circumstances receive a clear next step instead of an automatic pass or fail. No payment, email address or documents are needed to see the result.

For initial or further temporary family-partner permission. All amounts must be in British pounds (GBP), not rands. Figures are checked against the rules reviewed on 19 October 2026. This is preliminary screening, not a visa decision.

The sponsor’s status must be verified separately. Temporary-worker dependants do not use this family-partner calculation.

Which benefits can lead to adequate maintenance?

These include Personal Independence Payment, Disability Living Allowance, Scottish Adult Disability Living Allowance, Severe Disablement Allowance, Industrial Injuries Disablement Benefit, Attendance Allowance, Pension Age Disability Payment, Carer’s Allowance, Carer Support Payment, Child Disability Payment, Adult Disability Payment, Police Injury Pension and the specified Armed Forces compensation or War Pensions payments. The exact award must be checked. Universal Credit by itself is not one of these exemptions.

Your figures are calculated in this browser and are not submitted to LexMigrate or saved by this checker. Existing website analytics may record that the check was completed or a contact link was clicked, without your answers or amounts. Contact opens only when you choose a link.

From your figures to an application plan

LexMigrate assists with UK spouse and partner applications by reviewing the relevant financial position, identifying the evidence that needs attention and helping prepare a coherent application. Relationship history, accommodation, English-language requirements and any previous immigration issues must also be considered.

The checker is free. Individual financial assessments and application preparation are paid services, quoted before you instruct us. Request a written quotation setting out the assistance included, exclusions, professional fees and separate government or third-party charges.

Who can sponsor a UK spouse or partner visa?

The UK sponsor must usually be a British or Irish citizen, settled in the UK, have qualifying pre-settled status, have protection status, or fall within another recognised sponsor category under the family visa rules.

The applicant and sponsor must both be 18 or older and must intend to live together permanently in the UK after the application is granted.

Which relationship routes are covered?

The partner route can apply to different relationship categories, including:

  • a spouse in a marriage recognised in the UK;
  • a civil partner;
  • an unmarried partner where the relationship meets the relevant durability requirements;
  • a fiancee or proposed civil partner who will marry or enter a civil partnership in the UK within the permitted period; and
  • some cases where the couple has been in a relationship for at least 2 years but could not live together for practical, cultural or other accepted reasons.

Each route has different evidence issues. A married couple may still need to prove that the relationship is genuine and subsisting. An unmarried couple may need careful evidence of cohabitation or the reasons why cohabitation was not possible.

Main requirements for South African applicants

A strong spouse or partner visa application normally deals clearly with:

  • the sponsor’s immigration status in the UK;
  • the relationship and intention to live together permanently;
  • the financial requirement or adequate maintenance route;
  • suitable accommodation in the UK;
  • English language evidence, unless exempt;
  • a TB certificate where required;
  • identity and passport evidence;
  • previous immigration history, refusals or overstays; and
  • any children applying or forming part of the family circumstances.

The financial requirement

For many new partner applications, the combined income normally needs to be at least £29,000 per year. The financial rules are technical and the correct evidence depends on the source of income.

Employment, self-employment, savings, pension income, specified benefits, overseas employment and recent job changes are not assessed in the same way.

Common South African evidence problems

South African applicants often run into avoidable difficulties because the documents do not line up neatly with the facts in the application.

Common issues include:

  • bank statements and payslips not covering the correct period;
  • employment letters missing mandatory details;
  • unclear source of funds or large recent deposits;
  • relationship evidence that is emotional but not structured;
  • insufficient evidence where the couple has lived apart;
  • accommodation evidence that does not show the applicant can live there;
  • previous UK visits that are not explained consistently; and
  • attempting to rely on generic checklists instead of the facts of the case.

Fiancee visa or spouse visa?

A fiancee or proposed civil partner visa is for someone who intends to marry or enter a civil partnership in the UK after arrival. It is usually granted for 6 months. The applicant cannot work or study on that status and must apply to switch after the marriage or civil partnership.

A spouse or civil partner visa is different. It is based on a marriage or civil partnership that already exists and, if granted from outside the UK, normally gives permission for up to 2 years and 9 months.

Applying with children

Children may be included as dependants where the rules are met. The application must deal with age, dependency, parental responsibility, family arrangements, immigration history and whether the child is leading an independent life.

Where only one parent is moving to the UK with the child, the evidence around consent, sole responsibility or serious and compelling family circumstances may require careful preparation.

What if the financial requirement is not met?

Some cases may still be arguable under exceptional circumstances, human rights grounds, a child-based argument or the adequate maintenance route where the sponsor receives qualifying disability or carer benefits.

These applications need to be prepared differently. They should not be presented as if the minimum income requirement is met when it is not.

How long does it take?

GOV.UK currently indicates that partner applications made outside the UK usually receive a decision within 12 weeks. In-country applications that meet the financial and English requirements usually take around 8 weeks, while cases outside the standard requirements may take longer.

Priority options may be available, but availability depends on the application route and appointment system at the time.

How LexMigrate helps

We assess the route, confirm the evidence strategy, prepare a tailored document list, complete the application, review the supporting documents and draft legal representations where needed.

We are especially useful where there has been a previous refusal, a complicated financial picture, a blended family, children from previous relationships, limited cohabitation evidence, or a sponsor who has recently changed jobs.
