South Africa Intra-Company Transfer Work Visa

Attorney-led support for international businesses transferring existing employees into a South African branch, subsidiary or affiliate.

A South African Intra-Company Transfer Work Visa is designed for an existing employee of an international business who is being transferred from a foreign company to a branch, subsidiary or affiliate in South Africa.

It is a specific work-visa route under section 19(5) of the Immigration Act. It is not the same as a General Work Visa and it is not intended for a completely new hire who has no existing employment relationship with the overseas company.

LexMigrate assists international businesses and employees with intra-company transfer applications into South Africa, including transfers from Namibia and other countries.

Who is the Intra-Company Transfer Work Visa for?

This route is generally relevant where:

  • the employee already works for a company outside South Africa;
  • the overseas company has a branch, subsidiary or affiliate in South Africa;
  • the employee is being transferred into the South African operation;
  • the employee will continue working in the specific occupation and capacity approved under the visa; and
  • the corporate relationship and transfer can be documented properly.

The visa is therefore most commonly used by multinational businesses moving experienced employees into South Africa for a defined assignment.

How long is the visa valid?

Under the current Immigration Regulations, an intra-company transfer work visa may be issued for a period of up to four years.

The Regulations describe the visa as not renewable. Where the operational need continues beyond the period already granted, the next step must be considered carefully rather than simply assuming that an ordinary extension is available.

Does the employer need to advertise the position locally?

The intra-company transfer route is different from the General Work Visa route. VFS guidance confirms that an applicant under the intra-company transfer route is not required to prove that steps were taken to recruit a South African citizen or permanent resident for the position.

The focus is instead on proving the genuine transfer relationship and compliance with the specific intra-company transfer requirements.

How long must the employee have worked for the overseas company?

The Immigration Regulations require the foreign employee’s contract of employment with the company abroad to have been valid for at least six months.

This is an important distinction. The route is meant for an existing employee being transferred within a qualifying corporate group rather than a person recruited immediately before the visa application purely for the South African role.

What must the overseas company confirm?

The foreign company must provide evidence confirming that the employee will be transferred to a qualifying branch, subsidiary or affiliate in South Africa.

The corporate relationship must therefore be clear and capable of being evidenced.

What must the South African company confirm?

The South African branch, subsidiary or affiliate must confirm the transfer and specify the occupation and capacity in which the employee will be employed in South Africa.

The position stated in the immigration application should align with the actual assignment. The visa holder may work only in accordance with the conditions of the visa.

What undertakings must the employer give?

The employer has specific responsibilities under the Immigration Regulations.

These include ensuring that:

  • the foreign employee works only in the position for which the visa was issued;
  • the employee complies with the Immigration Act and the conditions of the visa;
  • the Department is notified if the employee refuses to comply with those obligations;
  • a plan is developed for the transfer of skills to a South African citizen or permanent resident; and
  • the company accepts responsibility for certain deportation-related costs if these become necessary.

These undertakings are not merely administrative wording. They form part of the employer’s immigration compliance responsibilities.

What is the skills transfer plan?

A skills transfer plan is a specific requirement associated with the intra-company transfer route.

The South African employer must develop a plan for transferring skills to a South African citizen or permanent resident.

The plan should be credible in the context of the employee’s role and the South African operation. It should not be treated as a generic paragraph copied into every application.

What evidence is normally relevant?

The exact evidence depends on the employee, the corporate structure, the country of application and the facts of the transfer.

Broadly, an application will normally need to establish:

  • the employee’s identity and immigration history;
  • the existing employment relationship with the foreign company;
  • the period of employment abroad;
  • the relationship between the foreign and South African entities;
  • the genuine transfer into South Africa;
  • the occupation and capacity in which the employee will work;
  • the employer undertakings required by the Regulations;
  • the skills transfer plan;
  • medical and police-clearance requirements where applicable; and
  • any mission- or VFS-specific submission requirements.

LexMigrate provides a case-specific document request after reviewing the transfer structure rather than relying on a generic checklist.

Where must the application be submitted?

The correct place of submission depends on the applicant’s circumstances and the applicable South African mission or VFS process.

Where an applicant is applying from outside South Africa, the application is ordinarily made through the South African mission or authorised visa application process serving the country where the applicant is lawfully resident.

For cross-border transfers, including Namibia to South Africa, the filing location should be confirmed before the application is finalised because the mission and local VFS process can affect the practical submission requirements.

Can the employee change employers after arrival?

An intra-company transfer visa is tied to the specific employer and transfer circumstances approved in the application.

The holder may not simply use it as an open work visa for unrelated employment in South Africa.

If the employment structure changes materially, immigration advice should be obtained before the employee begins working under the new arrangement.

Can dependants accompany the employee?

Family members may require their own appropriate South African immigration status. Their route depends on their relationship to the main applicant, their intended activities in South Africa and the duration of the stay.

Do not assume that the main employee’s work visa automatically gives a spouse or child permission to work or study.

Can this visa lead directly to permanent residence?

An intra-company transfer work visa should not be treated as an automatic route to permanent residence.

Permanent residence has its own statutory categories and requirements. If the employee’s assignment is likely to become long term, the immigration strategy should be reviewed before the four-year transfer period becomes a problem.

How long does an intra-company transfer application take?

Processing times vary by mission, country of submission and the individual application. VFS expressly notes that applications are assessed individually and that it cannot control the Department’s decision-making time.

Businesses should therefore build immigration lead time into the transfer plan rather than fixing an employment start date before the visa process has been assessed.

Common problems in intra-company transfer applications

Issues commonly arise where:

  • the relationship between the overseas and South African entities is unclear;
  • the employee has not been employed abroad for the required period;
  • the transfer letters do not align with the employment records;
  • the South African role is described differently across the application documents;
  • the employer undertakings are incomplete;
  • the skills transfer plan is generic or unrealistic;
  • the filing location is assumed rather than confirmed; or
  • the business fixes a start date that does not allow enough time for immigration processing.

Corporate planning matters

For employers, the best time to assess the visa is before the employee’s South African start date, relocation arrangements and travel bookings are fixed.

The immigration route should be considered alongside:

  • the employee’s contractual arrangements;
  • the relationship between the group companies;
  • the intended assignment period;
  • the South African role;
  • dependant family requirements; and
  • long-term workforce planning.

Frequently Asked Questions

Is an Intra-Company Transfer Work Visa renewable?

The Immigration Regulations state that the visa may be issued for up to four years and is not renewable. Where the business still needs the employee after that period, the circumstances and next immigration route should be reviewed carefully.

Does the employer need a Department of Employment and Labour recommendation?

The intra-company transfer route has different requirements from a General Work Visa. The application should be assessed under the requirements specific to section 19(5) and the current Regulations.

Can the employee work for another company?

No. The visa is linked to the approved employer and position. It is not an open work visa.

Can an employee be transferred to an affiliate rather than a direct subsidiary?

The Regulations contemplate a transfer to a branch, subsidiary or affiliate. The corporate relationship must still be evidenced clearly.

Can the application be submitted after arriving in South Africa as a visitor?

Do not assume that a visitor can simply enter South Africa and convert to the desired work status from inside the country. The correct filing strategy should be established before travel.
