H-2A, H-2B Visas and USRAP: Why Multiple U.S. Statuses Need Care

The U.S. Embassy South Africa USRAP FAQ addresses a practical question: if a partner has an H-2A or H-2B U.S. visa, can the family still apply to the refugee program? The FAQ states that having an H-2A or H-2B visa does not automatically exclude a person from USRAP. However, that does not mean the issue is simple.

The same FAQ also stresses that individuals are only eligible to access USRAP if they are living and physically present in South Africa. A person working in the United States, temporarily outside South Africa or relying on another status may therefore need careful advice before assuming that USRAP processing can continue normally.

The FAQ recommends consulting an immigration attorney where a person holds or is considering applying for another U.S. immigration status in addition to applying for refugee status through USRAP. This is because applying for or holding multiple U.S. visas or immigration statuses could impact eligibility for statuses held or sought.

This is a serious warning. Different U.S. immigration categories may involve different legal positions, intentions, representations and consequences. A temporary work visa and a refugee-resettlement process are not the same thing. If a person gives information in one context that conflicts with information in another, credibility and eligibility concerns may arise.

For example, a temporary work visa may involve a limited purpose and temporary stay. A refugee claim involves protection-based facts and an inability or unwillingness to return because of qualifying harm or feared harm. The existence of one does not automatically destroy the other, but the interaction should be considered carefully.

Family members should also think about location. If one partner is in the United States on an H-2A or H-2B visa and the rest of the family is in South Africa, the USRAP physical presence requirement may create a practical issue. The FAQ states that all members on the case, including children, must be physically present in South Africa for the case to be processed.

Applicants should not make assumptions based on informal social media advice. One person’s H-2A or H-2B situation may be different from another’s. The nature of the work visa, physical location, family composition, timing, prior statements, and the facts underlying the USRAP claim may all matter.

Where a person has already submitted the USRAP Intake Questionnaire and later obtains or considers a U.S. visa, the timing and content of both processes should be reviewed. Where a person already holds a U.S. visa before USRAP intake, the same care applies. The goal is not to panic, but to understand potential inconsistency or eligibility issues before they become a problem.
