South African citizenship

South African Citizenship and Status

Attorney-led help with citizenship by birth or descent, naturalisation, dual citizenship and status issues following the section 6(1)(a) judgment.

South African citizenship is a nationality status, not merely an immigration permission. Questions about citizenship can arise through birth, descent, naturalisation, previous loss of citizenship, reinstatement or uncertainty about whether a person remains a South African citizen.

LexMigrate assists with South African citizenship and status enquiries where the legal position or documentary history is unclear.

How can South African citizenship arise?

South African citizenship can arise through different legal routes, including birth, descent and naturalisation. The applicable route depends on the person’s date and place of birth, the status of their parents, their residence history and the legislation in force at the relevant time.

Citizenship should therefore be assessed from the legal history rather than assumed from a passport, ID document or family connection alone.

South African citizenship by birth

Citizenship by birth depends on the statutory requirements applicable to the person’s date and circumstances of birth.

Current citizenship legislation recognises that certain children born to South African citizens acquire citizenship automatically, while other people born in South Africa may have a later route to naturalisation if the statutory conditions are met.

South African citizenship by descent

Citizenship by descent can arise where a person is born outside South Africa to a South African parent and the legal and registration requirements are satisfied.

These cases often turn on whether the parent was a South African citizen at the time of birth and whether the birth and citizenship status were correctly recorded.

South African citizenship by naturalisation

Naturalisation is a discretionary statutory process for qualifying permanent residents and other eligible applicants.

Permanent residence is generally an important precursor, but naturalisation is not automatic merely because a person has lived in South Africa for a number of years.

The applicant must meet the legal requirements in force at the time of application and satisfy Home Affairs that the statutory criteria are met.

Does permanent residence automatically become citizenship?

No. Permanent residence and citizenship are different legal statuses.

A permanent resident has a secure immigration status but does not become a South African citizen automatically. A separate citizenship route and application are required where the person qualifies.

Can a South African have dual citizenship?

Yes, South African law can recognise dual citizenship.

The legal position changed significantly after the Constitutional Court’s 2025 judgment concerning section 6(1)(a) of the South African Citizenship Act.

The Constitutional Court confirmed that the provision which caused South African citizens to lose citizenship automatically when voluntarily acquiring another nationality without prior permission was unconstitutional and invalid from its commencement on 6 October 1995.

What if I previously lost South African citizenship after taking another nationality?

The Constitutional Court’s 2025 judgment is highly important for people who were previously treated as having lost South African citizenship under section 6(1)(a).

Home Affairs now states that people who lost citizenship under that provision are deemed not to have lost it.

The Department has introduced an online reinstatement process for affected applicants through My Home Affairs Online.

This should be distinguished from people who formally and voluntarily renounced South African citizenship. The Constitutional Court ruling does not simply reverse a voluntary renunciation.

Who may not benefit from the reinstatement judgment?

Home Affairs states that the section 6(1)(a) reinstatement process does not apply to people who voluntarily renounced South African citizenship.

It also does not apply in the same way to citizenship lost before the commencement of the 1995 Act under different legal provisions.

The person’s actual citizenship history therefore needs to be established before assuming that the reinstatement process applies.

How do I check whether I am still a South African citizen?

Home Affairs now provides an online process through My Home Affairs Online for people affected by the section 6(1)(a) issue to verify status and, where applicable, begin the reinstatement process.

In other cases, a citizenship-status enquiry may still require analysis of the person’s birth, parentage, naturalisation, foreign citizenship and any previous Home Affairs records or decisions.

Does holding a South African passport prove citizenship forever?

A passport is evidence of citizenship at the time it was issued, but complex citizenship histories should not be assessed from a single document alone.

Where there has been foreign naturalisation, renunciation, conflicting Home Affairs records or a long period outside South Africa, the legal status should be checked properly.

What if I was born outside South Africa to a South African parent?

You may have a citizenship-by-descent route depending on the law applicable to your birth and your parent’s status.

The analysis should establish whether the parent was a citizen at the relevant time and what registration or documentary steps were required.

What if I was born in South Africa to foreign parents?

Being born in South Africa does not always mean automatic citizenship.

South African citizenship legislation provides specific rules for children born in the Republic to non-South African parents. In some circumstances, a person who has lived in South Africa continuously from birth to majority and whose birth was registered may have a naturalisation route on reaching majority.

What documents are normally relevant?

The exact evidence depends on the citizenship question.

Broadly, relevant records may include:

  • birth certificates;
  • South African identity documents;
  • South African passports;
  • parents’ citizenship records;
  • naturalisation certificates;
  • foreign citizenship or naturalisation records;
  • renunciation or retention-related records;
  • marriage and family-status documents; and
  • Home Affairs correspondence or citizenship determinations.

LexMigrate provides a tailored document request after the citizenship issue has been identified.

What if Home Affairs records are wrong or incomplete?

Citizenship cases can become difficult where the legal position and Home Affairs records do not match.

In those cases, the first task is to establish the underlying legal status and documentary history before deciding whether the next step is a status enquiry, correction, reinstatement process or another citizenship application.

What about the 2026 citizenship reform proposals?

Cabinet approved a revised White Paper on Citizenship, Immigration and Refugee Protection in March 2026.

The White Paper proposes major changes to citizenship and naturalisation policy, including a more structured and potentially merit-based naturalisation framework.

These are policy proposals and should not be treated as if they have already replaced the South African Citizenship Act.

Current applications must be assessed under the law actually in force unless and until legislative amendments commence.

Common South African citizenship problems

Common issues include:

  • uncertainty after acquiring a foreign nationality;
  • confusion between permanent residence and citizenship;
  • assuming birth in South Africa automatically created citizenship;
  • missing or inconsistent Home Affairs records;
  • uncertainty about citizenship through a South African parent;
  • voluntary renunciation versus automatic historical loss;
  • passport or ID records that do not resolve the underlying legal issue; or
  • treating proposed 2026 reforms as current law.

Frequently Asked Questions

Did South Africans automatically lose citizenship when taking another nationality?

Home Affairs previously applied section 6(1)(a) in that way, but the Constitutional Court declared the provision unconstitutional and invalid from 6 October 1995. People affected by that provision are deemed not to have lost citizenship.

Do I need to reinstate citizenship if I was affected by section 6(1)(a)?

Home Affairs now provides an online process to verify status and obtain confirmation of reinstatement where applicable.

Does the Constitutional Court judgment reverse a voluntary renunciation?

No. Home Affairs expressly distinguishes voluntary renunciation from citizenship lost under section 6(1)(a).

Can a permanent resident apply for citizenship?

Potentially, once the applicable naturalisation requirements are met. Permanent residence alone does not automatically create citizenship.

Are the 2026 citizenship proposals already law?

No. The White Paper is policy. Existing citizenship applications must still be assessed under current legislation unless and until amendments are enacted and commenced.
