USRAP Eligibility for South Africans

USRAP eligibility is assessed individually. Being part of, referred into, or contacted through a South Africa-related USRAP pathway does not itself establish refugee status. The applicant must still satisfy the applicable US refugee definition, complete the required screening, and be found otherwise eligible and admissible by the competent US authorities.

The current South Africa-related policy context

In February 2025, the White House directed the Departments of State and Homeland Security to prioritise humanitarian relief, including USRAP admission and resettlement, for Afrikaners in South Africa whom the US administration describes as victims of unjust racial discrimination. In May 2026, an emergency Presidential Determination increased the Fiscal Year 2026 refugee ceiling from 7,500 to 17,500 and allocated the additional admissions to Afrikaners from South Africa under that policy.

That policy creates a programme priority; it does not create automatic refugee status. Each case remains subject to individual adjudication under US refugee law.

The central legal question

The applicant must show that they are outside the United States and meet the US refugee definition, including persecution suffered or a well-founded fear of persecution on account of a recognised protected ground. The facts must connect the harm or feared harm to that protected ground rather than rely only on general conditions in South Africa.

Protected grounds

  • race;
  • religion;
  • nationality;
  • membership of a particular social group; or
  • political opinion.

What we assess

  • the applicant’s personal history and chronology;
  • specific incidents of harm, threats, discrimination or other conduct relied upon;
  • why the applicant says the harm occurred;
  • whether the evidence supports the claimed protected ground;
  • family composition and derivative family members;
  • previous residence, travel, asylum or immigration history;
  • possible firm-resettlement issues;
  • potential inadmissibility concerns; and
  • consistency between the written case, documents and anticipated interview evidence.

What does not establish eligibility by itself

General dissatisfaction with conditions in South Africa, a desire to relocate, economic difficulty, crime affecting the public generally, or membership of a group identified in US policy does not by itself establish refugee eligibility. The case must still meet the legal refugee standard on its own facts.
